Creating Collective Easement Defense Resources: Options and Recommendations

Easement research shows that a majority of easement holders have not built adequate funds for the future defense and enforcement needs of easements. Additionally, financial resources are not the only outstanding need with regard to easement defense. There are other issues that affect our ability to defend easements, such as improved stewardship practices, and informed courts and attorneys.

Collective easement defense is the concept that financial and other resources could be created that easement holders could access to help fund easement defense cases. This study assessed a wide variety of options for meeting our collective easement defense needs at a national, state and regional level. The project began in June 2000 and was released in May 2002. The study was supported by the David and Lucile Packard Foundation, the Doris Duke Charitable Foundation, the Surdna Foundation, the Great Valley Center, and Land Trust Alliance.
